    The 20-Week Reflection Period

    Conditional Order (Formerly Decree Nisi)

    Divorce in England and Wales has changed for the better. The introduction of the No-Fault Divorce under the Divorce, Dissolution and Separation Act 2022 means a simpler, less stressful process for everyone involved.
    Here’s what’s different:
    1. No Blame, No Conflict:
    Before, you had to prove your marriage had irretrievably broken down. To do this, you had to blame one of the following:

    Adultery

    If your spouse had sexual intercourse with someone of the opposite sex. But it didn’t include emotional or same-sex relationships.

    Unreasonable Behaviour

    If your spouse behaved in a way that made it impossible to continue living together.

    Two Years of Separation

    If you were separated for at least two years and your spouse agreed to the divorce.

    Five Years of Separation

    If you had been separated for at least five years, regardless of your spouse’s opinion.

    Desertion

    If your spouse left you for at least two years.

    Apply Together or Separately

    In the past, one person had to file for divorce and the other person was called the respondent. This often led to conflict and unnecessary drama. Now, both of you can apply jointly for the divorce if you agree. It’s called a joint application, making it much easier and less stressful.
    If you prefer to apply alone, you can still do that, but the process is straightforward and without blame. It’s no longer a “him vs. her” situation.

    Before, you could only get a divorce after two or five years of separation or if your spouse was at fault. But with the new law, there’s no need to wait that long. You can start the process right away, with just a simple declaration that the marriage has broken down.
    Now, there is still a minimum 6-month wait. This includes a 20-week reflection period, where both of you have time to think things over, followed by the final stage to get your Final Order.
